Ellen's Edible Art L.L.C Cake Contract
As a cake, cookie and chocolate decorator, I agree to deliver your cake, and or items delivered in a timely manner.
The following conditions apply:
1) A deposit of 50% is required to consider this an order and contract for services rendered in your behalf. The remaining balance is due 3 weeks prior to the delivery date. Any changes to this order must be made no later than 3 weeks prior to delivery. If the order is canceled, 50% of the total order is non-refundable, plus any and all expenses incurred in behalf of the finished products. Payment via cash or check, for contract will be for non-payment and the customer must make other arrangements for the items. I agree that no changes will be made up to 3 weeks before the event date.

2) In the event you would like to use fresh flowers on your cake, the responsibility of the flower safety and safe food practices will rest with the florist and not with Ellen's Edible Art L.L.C.. The person placing this order should obtain a notice of plant safety, in question, from the florist. Initials required_____________________
3) If your cake or items require any equipment such as columns, cake plates, stands, ply board etc... There will be a rental fee of $15.00 plus returnable security deposit (RSD) on all pieces that will equal the cost of replacing any and all parts. I, Ellen's Edible Art will provide a list of all items rented. All items are to be returned to Ellen's Edible Art L.L.C within 3 days of the event, the day of the event and up to 2 days after. There will be a late fee of $25.00 per day for each day the items are late. If the items are returned broken or with lost pieces the full RSD will be forfeit to replace the items. RSD will be refunded when all rental items are cleaned by the client and returned in the same condition. If the items are returned dirty there will be a $20.00 charge kept out of the RSD. 4)The colors red, blue, and purple or any shade of theses colors cannot be guaranteed. These colors are not stable and tend to fade and or bleed into surrounding colors and frosting. For outdoor events there is no guarantee.
5) We currently DO NOT OFFER vegan, wheat free, gluten free or kosher cakes. Notify your guests of this risk, we are not responsible for allergic reactions. Be aware: Ingredients or machinery may have come in contact with nuts, milk and wheat products. Initials required.________________
6) In the case of an unavoidable occurrence, such as a car accident or poor road conditions or acts of God during the delivery Ellen's Edible Art L.L.C. cannot be held liable for more than the price of the cake or items described in this order.
7) The client will provide clear driving instructions to the location and inform Ellen's Edible Art L.L.C of any adverse road hazards and /or obstacles that may hamper the delivery and quality of finished cakes. ( PLEASE NOTE: excessive jarring due to "pot holes", road construction or unseen road conditions, will damage the finished product to an unstable and undesirable state.) 8) There will be a $30.00 minimum delivery and set up fee within 25 miles of our location, anything over that will be an additional charge. When we get the location address and directions, we will give you an exact fee. If you or your representative elect to pick up & set up the cake and/or items you assume all liability & responsibility for the condition of the cake and items once they leave Ellen's Edible Art L.L.C . We are not responsible for any damage to cake or items after the set up is complete. You are responsible for proving an appropriate and secure table and environment for the cake or items. Cakes are heavy and require a sturdy table, and optimal room and temperature of 75 degrees or below and out of direct contact with heat, sun, wind, rain or any other acts of nature beyond our control. 9) I have read and understand all that has been proposed, and I have received a copy of this contract for my records. Performance of this agreement is contingent upon the ability of Ellen's Edible Art L.L.C. to complete the agreement and is subject to accidents, acts of God, nature, and any other cause beyond our control.
